2.1. If you are Related or Associated Natural Person Representatives, Shareholders or Employees of Legal Entity Clients:

Your personal data may be obtained by our Bank if and to the extent shared directly with us or published in the public channels by the legal entity which you are related to and/or associated with and which is our client in respect of the transactions and operations entered into with our Bank by the legal entity you are related to or associated with.

We would like to remind you that the insurance firms will themselves directly act as data controller with regard to such insurance transactions as calculation of risks and premiums and payment of claims thereunder. Therefore, if you wish to get more detailed information about processing of your personal data, you may review and read privacy notices/policies published by insurance firms we are in cooperation with.

2.4. If you are Persons Included in Risk Group:

Article 49 of the Banking Law no. 5411 defines persons included in “risk group” as follows: As for real persons, the real person and his/her spouse and children, the undertakings where they are members of board of directors or general manager or the undertakings which they or a legal person control individually or jointly, directly or indirectly or participate with unlimited responsibility, constitute a risk group. As for a bank, the bank and its qualified shareholders, members of board of directors, and general manager as well as the undertakings they control individually or jointly, directly or indirectly or participate with unlimited responsibility or where they are members of board of directors or general manager constitute a risk group including the bank. For the implementation of this article, risk groups shall also include real and legal persons which have surety, guarantee or similar relationships where the insolvency of one will lead to the insolvency of the other. In addition, the Banking Regulation and Supervision Board is authorized to determine other real and legal persons included in a risk group.

  • To perform efficiency and expediency analyses of our commercial activities, and plan and carry out these activities and operations, and to this end, carry out marketing, promotion, publicity and gift sending activities, and perform market surveys and researches, and in this aspect, if your prior consent is taken, to send electronic commercial messages to you, and create tailormade products or campaigns specifically for you; and conduct general and tailormade segmentation activities; and determine and advise products or services you may be interest in or you may need and request.

4. METHODS OF COLLECTION OF PERSONAL DATA

Your personal data are collected from you, the Banks Association of Türkiye Risk Centre, Kredi Kayıt Bürosu A.Ş. (Credit Reference Agency), Identity Sharing System, legal entities you are related to and/or associated with, legal authorities and public sources at the time of establishment of your legal relations with our Bank or in the course of said relations, as well as via internet, by telephone or e-mail, through mobile applications, and through physical, written, verbal and electronic channels during your applications for products and services, and your visits to our head offices, internet web site and branches, and your use of mobile applications, ATM, internet banking and telephone banking, and your calls to call centre.

Where your personal data are transferred abroad, apart from the legal grounds listed in the table relating to said transfer, your personal data may be transferred abroad, providing that:

  • The foreign country to which your personal data will be transferred provides an adequate level of protection; or
  • In the absence of an adequate level of protection, HSBC and the data controller seated in the related foreign country to which your personal data will be transferred give a written commitment for adequate level of protection, and obtain prior consent of the Personal Data Protection Board; or
  • Your explicit consent is received for transfer of your personal data abroad.

5. WHAT ARE YOUR RIGHTS?

Pursuant to the provisions of Article 11 of the Law, you have the following rights in respect of your personal data:

  • To learn whether your personal data are processed or not; and
  • If your personal data are processed, to request information thereabout; and
  • To learn the purpose of processing of your personal data, and whether your personal data are used for the intended purposes or not; and
  • To learn the identity of third parties to whom your personal data are transferred in Türkiye or abroad; and
  • If your personal data are processed incompletely or inaccurately, to request completion or correction of them; and
  • To request deletion or destruction of your personal data; and
  • If your personal data are corrected, deleted or destroyed, to request notification of these transactions to third parties to whom your personal data are transferred; and
  • To raise objections against any consequences that may arise in disfavour of you as a result of analysis of the processed data solely and exclusively through automatic systems; and
  • To claim indemnification of your damages and losses, if any, incurred due to illegal or unlawful processing of your personal data.

6. IF YOU WISH TO CONTACT US FOR YOUR RIGHTS AND REQUESTS:

As per your legal rights, you may communicate your requests in writing to our branches either personally or via a notary public. In addition, you may transmit your requests to the address of hsbcbank@hs04.kep.tr by using your registered electronic mail (REM) address, secure electronic signature or mobile signature, or to kvkkiletisim@hsbc.com.tr address by using the electronic mail address previously advised to our Bank and registered in our systems.
